Terms of Service – BOOM-GEN APP

Welcome to BOOM-GEN. If you live in the United States, these Terms of Use are entered into between you and BOOM-GEN Technologies, Inc. («BOOM-GEN,» «we,» «us,» or the «Company»), located at 3400 Calloway DR STE 700, Bakersfield, CA 93312.

1. Introduction

By accessing or using BOOM-GEN’s services, you agree to be bound by these Terms of Use (the “Terms” or the “Agreement”), including our Privacy Policy, Cookie Policy, Community Guidelines, and Safety Tips.

RESOLUTION OF DISPUTES: PLEASE REVIEW THE DISPUTE RESOLUTION PROVISIONS IN SECTION 15 CAREFULLY. THIS SECTION REQUIRES, WITH LIMITED EXCEPTIONS, THAT ALL DISPUTES BETWEEN YOU AND BOOM-GEN BE RESOLVED THROUGH BINDING AND FINAL ARBITRATION, INCLUDING DISPUTES RELATED TO ARBITRABILITY. SECTION 15 ALSO INCLUDES A MANDATORY INFORMAL DISPUTE RESOLUTION PROCESS, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER.

2. Eligibility

You are not authorized to create an account or use the Services unless all the following are true:

You are at least 18 years of age.
You can form a binding contract with BOOM-GEN.
You are not prohibited by law from using our Services.
You have not been convicted of a felony or any crime involving violence or sexual misconduct.
You are not required to register as a sex offender with any state, federal, or local registry.

3. Prohibited Conduct

You agree that you will not:

Misrepresent your identity, age, or affiliations.
Harass, bully, stalk, or intimidate any other user.
Solicit money or items of value from another user.
Use the Services for any illegal purpose, including fraud or money laundering.
Use any robot, crawler, or automated process to access or extract data from the Services.
Disclose private information of other users without their permission.

4. Prohibited Content

BOOM-GEN prohibits uploading content that:

Is offensive, abusive, or promotes racism, hatred, or physical harm.
Contains nudity, graphic violence, or sexually explicit material.
Promotes self-harm or eating disorders.
Infringes on third-party intellectual property or privacy rights.
Relates to commercial activities (sales, advertising, or links to paid services).

5. Content Rights

Your Content: You own the content you provide. You grant BOOM-GEN a non-exclusive, royalty-free, perpetual, and worldwide license to use, copy, display, modify, and distribute Your Content to operate, develop, and improve the Services (including training our AI systems).
Member Content: You do not have rights to other users’ content and may only use it as intended within the Services.
Our Content: BOOM-GEN owns all text, graphics, logos, and software used in the Services.

6. AI Technology

BOOM-GEN may use software-enabled technology utilizing artificial intelligence or machine learning systems (“AI Technology”). You are solely responsible for all content generated by such AI Technology that you create, upload, or share.

7. Purchases and Subscriptions

Automatic Renewal: If you purchase a subscription, it will automatically renew at the then-current price until you cancel.
California Subscribers: You may cancel your subscription, without penalty or obligation, at any time prior to midnight of the third business day following the date you subscribed.
Refunds: Generally, all purchases are final and non-refundable. If you subscribed via Apple ID or Google Play, refunds are handled by those third-party services.

8. Account Termination

You can delete your account at any time via «Settings.» BOOM-GEN reserves the right to suspend or terminate your account without a refund if we believe you have violated these Terms or behaved inappropriately.

9. No Background or Identity Checks

BOOM-GEN DOES NOT CONDUCT CRIMINAL BACKGROUND OR IDENTITY VERIFICATION CHECKS ON ITS USERS. You are solely responsible for your interactions with other members. ALWAYS USE GOOD JUDGMENT AND FOLLOW OUR SAFETY TIPS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOM-GEN, ITS AFFILIATES, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR THE CONDUCT OF OTHER MEMBERS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE LAST 24 MONTHS.

11. Indemnification

You agree to indemnify, defend, and hold harmless BOOM-GEN from any claims, damages, or losses (including attorney fees) arising from your access to or use of the Services, Your Content, or your breach of this Agreement.

12. Digital Millennium Copyright Act (DMCA)

If you believe that any content infringes your copyright, please send a «Takedown Notice» to copyright@boom-gen.com with the physical/electronic signature of the owner, identification of the work, and your contact information.

13. Governing Law

The laws of the State of California and the Federal Arbitration Act shall apply to any Dispute, without regard to conflict of laws principles.

14. Selection of Forum

Any claim that is not subject to arbitration shall be litigated exclusively in the federal or state courts located in Kern County (Bakersfield), California.

15. Dispute Resolution and Arbitration

15a. Informal Process: Before filing a formal claim, you must send a detailed notice to legal@boom-gen.com and negotiate in good faith for 60 days. 15b. Individual Arbitration: Any dispute will be resolved exclusively through individual binding arbitration administered by National Arbitration and Mediation (NAM). 15c. Mass Filing: If 25 or more similar requests for arbitration are filed against BOOM-GEN by the same counsel or coordinated entities («Mass Filing»), additional protocols will apply to ensure the fair and efficient resolution of all claims. 15d. Class Action Waiver: You and BOOM-GEN waive the right to a jury trial and the right to participate in any class action lawsuit or class-wide arbitration.
